Please read these Terms of Use ("Terms") carefully before using HerGains (the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Not a Medical App
HerGains is provided for general educational and informational purposes only. It is not a medical device, diagnostic tool, or substitute for professional medical advice, diagnosis, or treatment. Nothing in the App, including responses from the in-app "Ask a Nutritionist" chat, is medical advice, and that chat is a scripted, non-clinical feature, not a licensed medical professional. Always seek the guidance of a qualified physician or other healthcare provider with any questions you may have about a medical condition, your nutrition, or your menstrual or reproductive health, and never disregard or delay seeking professional advice because of something you read or received through the App.
2. Eligibility
You must be at least 16 years old, or the age of digital consent in your jurisdiction, to use the App.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. Acceptable Use
You agree not to misuse the App, including attempting to reverse engineer it, interfere with its normal operation, or use it for any unlawful purpose.
5. Your Data
Information you provide through the App, including logs, goals, cycle data, and chat messages, may be used to operate, maintain, and improve the App. As described in our Privacy Policy, this includes using data for research purposes and to train and improve our models and products.
6. Third-Party Services
The App integrates with third-party services, such as authentication and session-booking providers, which have their own terms and privacy practices that apply when you use them.
7. Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied.
8. Limitation of Liability
To the fullest extent permitted by law, HerGains and its team are not liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the App.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
