These Terms of Service ("Terms") govern your access to and use of the HerGains website at hergains.app and the services, content, and information we make available through it (together, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service. Use of the HerGains mobile app itself is separately governed by our Terms of Use.
1. Who We Are
HerGains is operated by BuildLaunch. The Service exists to describe HerGains, the nutrition app for African women, and to help you learn about it, download it, and get support.
2. Use of the Service
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to misuse the Service, including by attempting to gain unauthorized access to it, interfering with its normal operation, scraping or harvesting content at scale, or using it in any way that could disable, overburden, or impair it.
3. Intellectual Property
The Service and its content, including text, graphics, logos, and the HerGains name and marks, are owned by BuildLaunch or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written permission, other than for personal, non-commercial use.
4. Third-Party Links
The Service may link to third-party websites or resources, such as app store listings or social media pages. We do not control and are not responsible for the content, policies, or practices of any third-party sites.
5. No Medical Advice
Nothing on the Service constitutes medical advice. HerGains, including any content referencing the in-app "Ask a Nutritionist" feature, is provided for general educational and informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
6. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
7. Limitation of Liability
To the fullest extent permitted by law, BuildLaunch and its team are not liable for any indirect, incidental, or consequential damages arising from your access to or use of, or inability to access or use, the Service.
8. Changes to the Service or These Terms
We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time; continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
9. Governing Law
These Terms are governed by applicable law without regard to conflict-of-law principles, and any disputes arising from these Terms or the Service will be resolved in accordance with that law.
